BL Plastering South East Wales Terms and Conditions


Services

BL Plastering will provide the services set out in the quotation of works.

BL Plastering can provide recommendations on contractors/sub contractors. However, BL Plastering will not be liable for recommendations of any contractors/subcontractors or any of there works provided. BL Plastering will take payments for the listed above and provide payment on your behalf but all works agreed will be with the contractor/sub contractor and yourself and any complaints will not be BL Plasterings responsibility to uphold.

Payments

Payment schedules will be provided with a non-refundable deposit to be paid on acceptance of quotation of works.

Payment schedules can be moved or delayed due to unforeseen circumstances (PLEASE SEE WORK DELAYS FOR MORE INFORMATION).

All invoices must be paid within 7 working days of completion of work.

If any part payments are missed or held off, BL Plastering reserve the right to cease all works until the payment has been made.

BL Plastering reserve the rights to cease any works and an invoice will be sent out with a new total owed from works completed.

Additional charges will be added to an invoice that has had a delayed/refused payment (Admin charges, postal charges, travelling expenses, personal cost, court fees and interest can be added).

If an invoice has not been paid within 7 workings days, a formal letter requesting payment will be sent by recorded delivery giving a further 7 days to make payment in full.

If the additional 7 workings days has passed after the formal letter has been received, court proceedings will be made to claim the non-payment of monies owed. Charges will be added to the final invoice resulting in a larger sum being collected due to expenses accrued.

Materials

All materials will be charged separately to labour and services.

Material costs will be charged and in advance of any works.

Material defects will not be the responsibility of BL Plastering but will be rectified to their ability.

Time delays caused by material supply issues or late delivery will not be the responsibility of BL Plastering.

Material costs estimated by BL Plastering is subject to price increases and decreases and BL Plastering will not be held liable for this.

Larger items will be delivered by independent delivery services or building merchants and no delivery dates or times can be given or guaranteed.

Imperfections in any material used will not be the responsibility of BL Plastering and will need to be investigated by the supplier.

Removal of materials, new fittings or labour charges will apply and will be chargeable to the customer. BL Plastering may waver the charge under certain circumstances.

Building waste disposal

BL Plastering will not be liable for the disposal of building waste material.

Skip hire can be provided with a licence if off road space is not available.

If skip hire is refused, BL Plastering will not be liable for removal of any waste material.

Cancellation of skip hires will result in the collection of the full payment unless skip hire has not been booked at the time of cancellation.

Costs of skip hire and licences will be payable in advance together with the non- refundable deposit.

Scaffolding hire

Scaffolding hire can be organised by BL Plastering.

BL Plastering will not be liable for any damages caused by the scaffolding or scaffolders.

Delays will not be the responsibility of BL Plastering

Costs of scaffolding will be charged separately to any quotation provided for works.

Costs of scaffolding can increase due to company charges.

Licences will be required.

4 week hire will be priced.

Cancellation of scaffolding must be within 7 days of the scaffolding being erected or the total will be invoiced.

Scaffolding charges and licences will be made payable in advance with the non refundable deposit.

Sub Contractors

BL Plastering will not be liable for any time delays due to sub- contractor’s work schedules, damages or faulty work.

Additional work of the subcontractor will not be provided through BL Plastering and you will be forming your own agreement with them.

All work carried out by BL Plastering’s subcontractors will be to a satisfactory quality. If this is not to your satisfaction, all disputes will be taken up with you, the customer and the contractors.

Damages, delays and price increases caused by subcontractors will not be the responsibility of BL Plastering and any contact details will be provided to resolve said issue(s).

Any works done by contractors or sub contractors will not be BL Plasterings responsibility, We will only take payment and pay on your (customers) behalf. Contact details will be provided of the contractor/ sub contractors for any complaints or issues as your agreement to use them is with yourself and them.

Additional work required

BL Plastering will give notice of any additional work required.

In events that unforeseen work hasn’t been quoted by us in an original quotation, a price will be given to the customer for the additional work with notice before said work will continue.

If the additional work quotation was not accepted, BL Plastering reserve the right to withdraw from the agreed works with 50% of the quoted balance to be paid. If the sum of works are higher than 50% of the original quote, BL Plastering will send an invoice totalling the amount of work completed. If a non-refundable deposit has been paid this will be deducted from any balance owed.

If any additional work is required we will give notice but if we haven’t given a price for the additional work this will be listed as good will on our invoice. If any disputes arise and payments are withheld we reserve the rights to charge for the good will.

Damages

Any damages caused by BL Plastering will be cleaned, fixed or replaced within reason.

The customer will need to provide receipts for any damaged items.

If a receipt cannot be provided, BL Plastering reserve the right to clean or replace at their discretion.

Any damages caused by subcontractors will not be the responsibility of BL Plastering.

BL Plastering has full liability insurance.

All damage complaints must be photographed and sent to [email protected]

All damage complaints must be made within 24 hours of completion of works.

Work Delays

Once the quotation of works and a non-refundable deposit has been paid, an estimated start date will be provided.

All start dates are subject to change due to unforeseen circumstances, time delays on previous jobs and customer requirements etc.

Time schedules are subject to change due to the reasons quoted above.

BL Plastering will not accept any time delays as a reasonable excuse to withdraw from quoted works.

BL Plastering will not be liable due to time delays on works undertaken and no compensation will be provided as all bookings dates and completion dates are estimated.

If any additional work is required any estimated dates will change due to the work required, drying times etc.

The above list is a guideline to unforeseen circumstances.

Liquidated damages will not be upheld by any time delays, unforeseen circumstances, damages or subcontractor issues.

Bookings and work dates/schedules

Start dates will only be given once a non-refundable deposit has been paid.

All dates are subject to change.

If any additional work is required this will change any dates provided.

Start and completion dates are only estimated and no compensation will be given due to any changes.

All bookings are in acceptance of the terms and conditions of this document. BL Plastering will not be liable for any delays of work.

All payments must be paid on the part payment dates or if part payment schedules were not in place up to 7 days of completion or invoicing.

BL Plastering will require an e-mail address, land-line number and mobile number to keep in regular contact.

Complaints

All complaints must be made in writing and sent by e-mail to [email protected]

All complaints must be in writing and not discussed in person.

All complaints will be dealt with professionally and in writing. BL Plastering will try and resolve all issues within 72 hours of contact.

BL Plastering must be given the opportunity to correct any issues within 14 days of contact.

Deductions in costs will not be given due to complaints of delays or quality of workmanship. BL Plastering has 14 days to resolve any issues that a customer has highlighted.

Cancellation/withdrawal from work

Customers need to contact BL Plastering within 48 hours of the agreed estimated start date to withdraw from the quoted work.

All customers that are not happy with the quality, time schedules, delays, or any other reason to withdraw/cancel from quoted works will need to follow our complaints procedure and will be charged to the value of the works carried out to date.

A 20%-30% withdrawal fee will be added usually totalling the non- refundable deposit charge. This fee is only charged for cancellations of upto 48 hours before estimated start date.

Any customer requesting to withdraw from quoted works at any stage after the estimated start date will be charged to the sum of the works completed. We will not reduce any costs due to a withdrawal from work and will invoice to date.

Material will be refunded up to £100. Any additional material costs will not be refunded. This refund is only acceptable to withdrawal from quoted works 48 hours in advance of the estimated start dates.

Skip hire and scaffolding hire with or without licence costs will not be refunded.

BL Plastering reserve the right to withdraw from any works quoted and accepted at any time.

BL Plastering will refund the 20%-30% non refundable charge if they withdraw from accepted works.

No compensation can be claimed by either parties due to cancellation or withdrawal.

Non Refundable deposit

A non refundable deposit of 20%-30% will be taken on acceptance of quotation.

No estimated start dates will be provided until the non-refundable deposit has been paid by one of the payment methods (PLEASE FIND ALL PAYMENT METHODS UNDER PAYMENTS)

The non-refundable deposit will not be refunded under any circumstances except following withdrawal or cancellation by BL Plastering.

Non Refundable deposits will be deducted from the invoiced amount.

Non-charged items, free labour or good will

If BL Plastering marks any material free on invoices or quotations, this is a good will gesture on the condition that full payment will be made upon request or invoicing.

If any payments are not paid, BL Plastering reserve the right to charge for the said good will gestured items listed on any invoices or quotations.

BL Plastering may do small additional work/labour as a gesture of good will. BL Plastering reserve the right to charge for this if any disputes arise.

Invoices must be paid in full and on time to receive any good will gestures

BL Plastering will invoice additional costs of any additional material or labour that has been marked as free due to non payments. This will increase any amounts outstanding (PLEASE SEE PAYMENTS FOR MORE INFORMATION)

Feedback

All feedback is welcome but we will not tolerate any abusive, threatening or slanderous comments. We will take any of the above mentioned further, potentially leading to legal proceedings.
